WHAT IS AN HOA?
What is a Home Owners association (HOA)? 

HOAs are associations of homeowners formed to maintain a development's common areas and protect property values. Restrictions spelled out in property deeds require homeowners to comply with their rules and pay assessments (dues) for common expenses. 

By purchasing into the Wenatchee Windsong Homeowners Association, the homeowner agrees to abide by the previously established covenants. The homeowners live close to his or her neighbors, share a common irrigation system, and voluntarily sacrifice certain freedoms, all for the cause of protecting communal property values and reducing nuisances. Reasonable restrictions, consistently enforced over time, will preserve the net value of the community and maintain a high quality of life for residents. 

History of Windsong and Creation of Standards 

The developer, Real Homes, initially set the standards for the community and had these standards inscribed in a legal document that created the community and set up the Windsong Association. This document is referred to by many names but most commonly is called the declaration of covenants, conditions and restriction (CC&R's) or the covenants. 

Restrictions generally have a negative connotation, but in this context they are very beneficial to owners within the community because of the protection they provide for individual owners. 

The document prescribes what the land may be used for and, also what it cannot be used for. Business use is restricted, as is signage, and any activity that may be regarded as a nuisance to the community. Buying a home in Windsong and consequently its homeowners association provides the purchaser with a degree of certainty as to the appearance and activities permitted within the community. 

April 15th, 2009 Real Homes sent homeowners a billing and call for appointment of the Board of Directors to enable the developer to transfer his authority and financial responsibility to the homeowners. That meeting was held April 30 th, 2009 and the core board was appointed, and it was decided that the incorporation of the association would be provided by the treasurer, as she had professional experience doing so. That decision saved homeowners over $3500 in professional fees. 

Jon Port sent out a second notice and another call for additional board members. 13 Homes were represented at that meeting and the rest of the board was determined. 

The CC&R declaration predetermined the dues amount for the association and it was signed by every homeowner upon purchase. 

It was required for the association to incorporate as it was no longer controlled under Real Homes. During that process the covenants were the legal governing document for conducting business, and granted the initial board authority under Washington state law, Chelan County and the City of Wenatchee.
